ADGM: ODP guidance under Data Protection Regulations 2021 – Part 4: Data subject rights and remedies

Summary

The Office of Data Protection ('ODP') within the Abu Dhabi Global Market ('ADGM') released eight guides on 11 August 2021 to assist with compliance to the Data Protection Regulations 2021 ('the 2021 Regulations'). These guides cover data subject rights such as the right to be informed, access, rectification, erasure, restriction, data portability, objection, and not to be subject to automated decision-making. Controllers are obligated to facilitate these rights and processors must assist controllers in doing so. The guides also detail the conditions under which requests can be refused and the restrictions on data subject rights. Additionally, the Part 8 Guidance addresses how individuals can raise concerns, exercise rights, seek redress, and the possibility of claiming compensation for breaches of data protection law.
